A Khata certificate is a legal document used for computing and filing property tax in Karnataka. It contains all the property details, such as the owner’s details, property size, location, carpet area, built-up area, tax assessment, and property identification number. The municipal corporations maintain the document, and it serves as a record of payments.

A Khata document is different from a title deed. The Khata is used for assessing the property tax, while the title deed is a written document signed between buyers and sellers. This legal document does not provide ownership but identifies that the owners are liable to pay taxes.

Importance of Khata

All properties within the limits of Bruhat Bengaluru Mahanagara Palike (BBMP) must have a Khata certificate. Obtaining a Khata document is vital for getting building licenses, layout plan approvals, and bank loans in different parts of the State. Owners can easily get electricity and water connections if they have the Khata document.

Types of Khata

The Khata certificate is categorised into two entities-‘A’ Khata and ‘B’ Khata.

A Khata is issued to a property which has all approvals from the concerned authorities and adheres to the building byelaws and taxation norms. The possession of this certificate helps property owners avail home loans, building plans and occupation certificates easily.

B Khata is issued to properties that violated the building byelaws or have outstanding property tax dues. It is a register maintained by BBMP as per Section 108A of the Karnataka Municipal Act, 1976, which was revised in 2009. It is a temporary document which needs to be converted into A Khata. The State government is working towards a scheme [SG3], which will allow the regularisation of B Khata properties to A Khata by paying the requisite improvement and conversion fee.

Apart from these two types of Khata, there is E Khata. It is the certificate filed or issued online. This certification allows property holders to make online payment of their property taxes.

Documents required to obtain Khata certificate

Usually, a Khata is essential for registration of newly allotted properties, transfer of properties, bifurcation of properties and merging of properties. All property owners can apply for the Khata certificate by furnishing the documents below:

  • Attested copy of the title deed
  • Allotment papers issued by the State’s Housing Board
  • Previous tax paid receipts (if any)
  • Documents of the profession
  • Property location
  • Building layout plan

Earlier, B Khata properties were entitled to some of the rights which A Khata properties have. However, after the Karnataka High Court passed an order in December 2014, the former lost whatever legal status it had. As of now, B Khata properties are identified as illegal properties, and they must be converted to A Khata to enjoy trading, construction and transferring of property rights. Application forms and accompanying documents should be submitted to the Assistant Revenue Officer or another officer in charge of Khatas in a municipal corporation. Khata certificates can take up to five weeks to be delivered after an application is processed.
